Additional comments

  • If you buy a property with a loan, you will be charged costs, duties and fees for receiving the purchase deed and costs, duties and fees for receiving the loan deed. This requires different simulations on the notaire.be website .
  • In the case of financing, it is advisable to ask your banker about the possibility of concluding a mortgage mandate in addition to a mortgage registration, in order to reduce the registration fees linked to the financing credit. This requires different simulations on the notaire.be website .
  • In the event of the sale of a property, the seller will be charged a fee for negotiating and finalizing the sales agreement. These fees range from €242 to €500 (VAT included), in addition to the costs of obtaining and producing the documents to be submitted by the seller.
  • In the event of the sale of a property subject to a mortgage registration, the seller will be required to pay fees and charges for the receipt of the deed of discharge, despite full repayment of the loan on which the registration is based. These fees usually range from €1,200 to €1,300 (incl. VAT).
  • Certain services may entail additional consultancy fees and charges (e.g. : planning a purchase in dismemberment of ownership, acquisition/sale with intervention of a legal incompetent, preparation of an IOU, tax request by separate application, notification of a town planning division, drawing up a related will,...).
  • The management of a particular difficulty, even if not related to the client's facts, will generate an additional consultancy fee (example: management of urban planning issues, polluted soil, hidden defects, special negotiations with a creditor, etc.). The additional fee will be calculated at an hourly rate of €150 excluding VAT (€181.50 including VAT).
  • Sale through our office:
    • Public biddit sale: costs to be borne by the seller, generally between 7,500€ and 9,000€ VAT incl.
    • Private sale (occasional and accessory activity): 2% excl. VAT of the sale price
  • Costs and fees for transactions not carried out after opening a file:
    • Invocation of a suspensive condition of non-obtainment of credit: €500 excluding VAT, to be increased by any disbursements made on behalf of the customer.
    • Abandonment of file, termination by mutual consent or resolution to the detriment of one of the parties (costs to be borne by the party concerned): €500 excluding VAT, to be increased by 1/3 of the fees to be increased and any disbursements incurred by the customer.
  • Power of attorney received by deed:
    • Power of attorney received on the day of signature of the deed of purchase/sale: free of charge
    • In all other cases: €322.25 incl. VAT, plus translation, apostille and travel costs.

Fees apply both to donations recorded in a notarial deed and to donations under private signature recorded in a joint pact with legalization of signatures, with a minimum charge of €350 inc. tax. Additional fees may be charged for urgent donations.

NB: this fee may be increased by 50% if the case is considered complex in view of the circumstances involved (e.g. foreign assets) or in the event of an urgent situation (e.g. late notification in view of remaining tax deadlines).

    Hourly rate

The statement of costs and fees for the inheritance declaration will be sent to the client at the same time as the draft inheritance declaration. Payment should be requested by the day of signing the declaration of inheritance at the latest, by bank transfer to the firm's account, using the reference number shown on the statement.

The inheritance tax assessment notice will be sent to the firm by the relevant inheritance tax office, with a copy to the heirs. Inheritance tax must be paid within 6 months of the date of death to the inheritance tax office by bank transfer to the account and with the reference mentioned on the tax assessment.

If a notarized transaction is not carried out following the opening of a file and is not completed for a reason that cannot be attributed to the notary's office, fees amounting to 1/3 of the tariffed fees as well as administrative costs and disbursements relating to the planned transaction may be claimed from the client.
